BOTTEGA DEL VINO is pleased to provide you with access to the websites owned or operated by PROVENANCE FOOD AND WINE PTY LTD (ABN 36 130 199 316 – LIQUOR LICENSE LIQP770010213) and its related bodies corporate including, but not limited to the website located at www.bottegadelvino.com.au (BOTTEGA DEL VINO Website) on these terms and conditions.

By accessing or using the BOTTEGA DEL VINO WEBSITE you agree to be bound by these terms and conditions of use as amended from time to time. If you do not agree to these terms and conditions, you may not use the BOTTEGA DEL VINO Website.

You represent and warrant to BOTTEGA DEL VINO that you are at least 18 years of age.

BUYERS AND SELLERS AGREEMENTS

Specific additional terms and conditions apply to the purchase and sale of wine through the BOTTEGA DEL VINO Website. Your acknowledgment of these terms and conditions is required to complete any transaction on this site. To the extent of any inconsistency between these terms and conditions and the additional terms and conditions, the additional terms will prevail to the extent of the inconsistency.

RESPONSIBLE SERVICE OF ALCOHOL

BOTTEGA DEL VINO supports the Responsible Service of Alcohol. New South Wales: Liquor Act 2007. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Victoria: WARNING: Victoria Liquor Control Reform Act 1998: It is an offence to supply alcohol to a person under the age of 18 years (Penalty exceeds $7,000), for a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $600). WARNING. Under the Liquor Control Act 1988, it is an offence: to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises; or for a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises. South Australia: Liquor Licensing Act 1997, Section 113. Liquor must NOT be supplied to persons under 18. Queensland: Under the Liquor Act 1992, it is an offence to supply liquor to a person under the age of 18 years. Under Australian laws, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By opening an account with BOTTEGA DEL VINO and/or placing an order you are confirming to us that you are at least 18 years of age.

BOTTEGA DEL VINO also recommends that alcohol only be consumed in moderation.

LIMITATION OF LIABILITY

To the full extent permitted by law, neither BOTTEGA DEL VINO nor you will be responsible for any losses that were not foreseeable to both parties at the time of entry into these terms and conditions or for any loss of profits, loss of revenue or loss of savings, however caused (including, without limitation, loss arising in contract, negligence or other tort, statute or otherwise).

Certain legislation, including the Trade Practices Act 1974 (Cth), may imply warranties or conditions or impose obligations upon BOTTEGA DEL VINO which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. These include without limitation terms relating to services being rendered with due care and skill and goods being of merchantable quality or fit for purpose for which they were supplied to you. These terms and conditions must be read subject to these statutory provisions. If these statutory provisions apply, notwithstanding any other provisions in this Agreement and to the extent to which BOTTEGA DEL VINO is entitled to do so, BOTTEGA DEL VINO limits its liability in respect of any claim under those provisions to:

  •  in the case of goods, at BOTTEGA DEL VINO’s option:
    •  the replacement of the goods or the supply of equivalent goods;
    •  the repair of the goods;
    •  the payment of the cost of replacing the goods or of acquiring equivalent goods; or
    •  the payment of the cost of having the goods repaired; and
  •  in the case of services, at BOTTEGA DEL VINO’S option:
    •  the supplying of the services again; or
    •  the payment of the cost of having the services supplied again.

Other than as set out above, BOTTEGA DEL VINO will not be responsible for any claims arising out of or in connection with your access to and use of the BOTTEGA DEL VINO Website and related services whether arising in contract, tort (including negligence), indemnity, strict liability, breach of warranty or statute.

For the purposes of this section, the term BOTTEGA DEL VINO will mean BOTTEGA DEL VINO and its officers, employees, contractors and agents, whether individually or collectively.

 

ORDERING

AVAILABILITY

Although we are usually able to prepare or ship your order on the same day, occasionally, tremendous demand will deplete our stock of a particular product. If this is the case, the item will be placed on backorder and we will notify you via email once the order is finalized and ready to collect or being shipped.
Please note that prices on bottegadelvino.com.au are subject to change without notice.

CLICK & COLLECT TERMS AND CONDITIONS

Click & Collect allows you to purchase goods from www.bottegadelvino.com.au for collection at BOTTEGA DEL VINO, 77 Macleay Street Potts Point NSW 2011 when it's convenient for you.

Collection of Click & Collect Orders are available from BOTTEGA DEL VINO store, 77 Macleay Street Potts Point NSW 2011.

BOTTEGA DEL VINO will contact you via email when your Order is ready for collection. Orders will generally be available for collection within 3 to 5 days from the date you place your Order.

In peak trading periods or where item/s in your Order are not available and need to be sourced from another fulfilment location, this may result in delays in fulfilment. BOTTEGA DEL VINO will notify you of the delays and discuss alternative arrangements.

Click & Collect Orders must be collected within 7 days from the date you are notified by email that your Order is ready for collection. If your Order is not collected within this time, the relevant BOTTEGA DEL VINO has the right to allocate those goods to another customer and refund you. An administration fee may apply in the instance where you fail to collect your goods within the required time frame.

When collecting your goods at BOTTEGA DEL VINO, you are required to supply a copy of your order confirmation email (printed or on your smart phone) and photo identification.

If you are not personally available to collect the goods, you may appoint a representative. The name of the representative must be included on your order form. The representative is required to supply a copy of your order confirmation email (printed or on their smart phone) and photo identification at the time of collection. The representative must be over 18 years of age to collect the goods on your behalf, and you agree that we will be entitled to rely on the representative's instructions as if they were your own.

If you are unable to collect the goods from BOTTEGA DEL VINO, you may contact us via email at info@bottegadelvino.com.au and arrange – if possible - to have the goods delivered. A delivery fee may apply.

BOTTEGA DEL VINO reserves the right to change or discontinue the Click & Collect service at anytime, without notice.

RETURNS AND EXCHANGES

We are confident you will love your selection. If for any reason you wish to send it back, we accept returns within 30 days of collection of the order or receipt of the package.

Return the product to the address below via Registered Post (please keep your receipt should you need to track your package). Remember to insure it for full value. Please note that all components of a gift set or collection must be returned.

Unfortunately, we can not accept returns for perishable items.

We regret that shipping and handling charges are non-refundable. Shipping and handling charges will be applied to all exchange orders. If a product is damaged or defective, its replacement will be shipped free of charge.

CANCELLATION POLICY

Orders may be cancelled with advance notice. If you wish to cancel a recently placed order, we will do everything possible to honour your request; however, if the order has begun its journey through the handling and shipping process, it cannot be cancelled or revised. If your order has already entered the shipping process, we will gladly accept your return of any non-perishable items (please see the return policy).

VOUCHERS & CREDITS

From time to time BOTTEGA DEL VINO may issue vouchers or credits for redemption against future purchases of goods.

Where a voucher or credit is offered by BOTTEGA DEL VINO as a registration/signup/joining offer for new members, then a member/person can only claim one of these registration/signup/joining credits or vouchers if they are not a current BOTTEGA DEL VINO member and the member must be registering/signing up/joining BOTTEGA DEL VINO for the first time. Additionally, only one registration voucher or credit may be claimed per household/delivery address. Where multiple BOTTEGA DEL VINO accounts are set up in breach of this term, BOTTEGA DEL VINO reserves the right to cancel the voucher or credit and to cancel any orders placed, and to recover the value of the voucher or credit from the member where orders are unable to be cancelled prior to delivery.

Each voucher or credit may only be redeemed once per household/delivery address.

BOTTEGA DEL VINO conducts regular audits of voucher and credit usage and reserves the right to recover amounts owing from customers who redeem more than one voucher or credit per household/delivery address/voucher promotion, or who are in breach of the terms attached to the particular voucher or credit or who obtain the voucher or credit through fraudulent or unauthorised channels or who set up multiple BOTTEGA DEL VINO accounts in order to obtain multiple vouchers or credits.

Vouchers may not be used in conjunction with any other vouchers - strict limit of one voucher per order. Any terms and conditions on a voucher or credit apply and bind the holder of the voucher or credit. Vouchers and credits are non-transferable and may not be redeemed for cash. All vouchers and credits will have an expiry date, after which the voucher or credit will no longer be redeemable.

Vouchers must be used in a single transaction and any unused value cannot be redeemed in any way.

Where a Voucher has a minimum spend requirement, then the voucher can only be redeemed if the value of the products ordered exceed the voucher's minimum spend requirement.

Vouchers and credits cannot be applied to orders retrospectively.

In addition, we urge you to keep your password in a safe place and not to share this with anyone. BOTTEGA DEL VINO is not responsible for any order not received, processed or accepted due to technical difficulties. To the extent permitted by law, we provide the BOTTEGA DEL VINO Website and the Services without any express or implied warranty or condition regarding the performance of the BOTTEGA DEL VINO Website. To the extent permitted by law, all express or implied conditions or warranties in connection with the any goods offered for sale on the BOTTEGA DEL VINO Website are excluded.
